Elderly woman causes near-fatal accident in Pennsylvania

Recently we wrote about a car crash in Allentown, Pennsylvania, that ended up involving a house being run into. That accident has now been eclipsed by a near-fatal crash in Maxatawney Township in late November, caused by an 84-year-old woman smashing her car through the window of a new thrift store, which then skidded across the linoleum tiles and struck two girls, ages 1 and a 3 years old.

The older girl was trapped under the car, which stopped when it struck a store wall. Both girls suffered serious injuries and were taken to Lehigh Valley Hospital - Cedar Crest. Both girls apparently had cuts and bruises a nd possible facial fractures, though they are thankfully expected to recover.

Often the difference between a serious collision and a fatal accident is simply luck. Police continue to investigate the cause of the incident in which the elderly woman drove over a concrete barrier and through the store's front window. The store is located in a strip mall, and police are said to be examining whether the accident was the result of driver negligence or a mechanical error.

In either instance, the family of the girls will undoubtedly seek full accountability from all negligent parties. All parties will need to tread carefully as they investigate their rights and responsibilities under Pennsylvania law, a law that clearly permits those injured due to the negligent actions of others top recover monetary damages for their losses, including pain and suffering occasioned by any injuries. Additionally, if it is proven that a defect in the woman's car caused the accident, she could likely sue the automaker for her injuries.
