Pennsylvania defective products: bicyclists at risk

Retailers carrying Specialized bicycles are offering support for free replacement of faulty forks on several models of the popular bicycle brand name. Those Pennsylvania cyclists who have a bike or front fork parts made by Specialized should note the details of the defective products recall. Riders have reportedly experienced problems with the front forks of the bikes, which have broken and caused injury to some.

The Consumer Product Safety Commission reports that four riders have suffered facial fractures and head injuries. Bicycle models for both men and women for 2008 and 2009 are believed to be affected. Some 18 different models and possibly more are covered under the recall, and it is recommended that use of the bikes be discontinued immediately. They should be returned immediately to the nearest authorized Specialized dealer for replacement of the defective fork at no cost to the consumer.

Those who have been injured may have grounds for a products liability lawsuit seeking recovery of medical costs and other damages. Pennsylvania law allows for those injured due to the ordinary use of a defective product to pursue claims for financial recovery. Any such claim is typically based on evidence of negligence that caused or contributed to the injuries suffered.

The defective products were manufactured in China by the company Kinesis and were placed on the Globe bike model for Specialized. For those riders that truly enjoy the sport, a sudden facial fracture is probably the last thing on their minds during a bike ride. The injuries sustained can be life altering if the accident were to occur on a busy road with vehicles nearby. Accordingly, the defective products recall notice should be reviewed carefully and appropriate actions taken to avoid the possibility of injury. Pennsylvania residents who have already suffered injury may benefit from investigating their legal rights under our state laws.
