Defective implant cause for Pennsylvania product liability suit

A Pennsylvania man is filing a product liability suit against a medical technology company that produced the artificial knee that he had implanted by surgeons. The suit also claims negligence along with product liability stemming from his injuries. A report would not identify the compensation amount he is seeking, just that it was enough to cover medical and legal costs and the sum he has lost and will continue to lose due to being unable to work because of the defective implant.

The report did not state the reason the man had to have his knee replaced to begin with but, after the original surgery, the replacement knee device malfunctioned in some way while he was out walking. He had to endure a second surgery for yet another knee replacement. At the time he filed the suit, he was still having problems with his knee even though the defective product had been replaced. Both scar tissue and extensive physical therapy have reportedly kept him from everyday activities.

Because the knee replacement product was guaranteed by the manufacturer to be reliable and with no defect, the plaintiff trusted that the company had produced a quality product. He now feels that they did not ensure that the artificial knee was in proper working condition before they marketed the product. His suit claims the warranty on the knee was violated.

If a person has the need for any product, whether it is to replace a body part or to perform any other job, there is a reasonable expectation for that product to work as advertised. When it does not and the buyer is injured, a product liability suit may be filed to receive reimbursement for costs associated with the resulting injury. Pennsylvania residents who have sustained injuries from defective products should explore their options regarding financial compensation.
