TRUCK DRIVERS' MEDICAL CONDITIONS PUT OTHERS AT RISK

An accident this past summer in Pennsylvania's Pocono Mountains illustrates the dangers that drivers can face when they share the road with truck drivers who have medical conditions. In this instance, a truck driver blacked out, and his truck crossed the median and struck a bus filled with Italian tourists. Three people were killed, including the bus driver, and 13 people were injured.

Later medical tests revealed that the driver had had a 90% blockage in one of his arteries. The resulting lack of blood flow caused him to pass out. The driver had also reportedly been on blood pressure and diabetes medications.

By law, truck drivers must pass medical tests that ensure they are able to drive safely, as well as do the necessary safety checks before and after a trip. Furthermore, there are certain conditions that disqualify a person from being able to drive a commercial truck at all, including epilepsy, hearing loss and vision loss. Certain conditions only disqualify a driver if they are thought to be likely to impair that person's ability to drive.

A truck driver's medical status could become a point of evidence in a lawsuit following a crash. In the Poconos accident, the driver claimed that he only found out about his blocked artery after the accident.

If you've been injured in a truck accident, it's important to speak with a personal injury lawyer who can evaluate your situation and advise you of your rights, as well as what it might take to build a case against the parties responsible for your accident.
