Chinese elevator death exemplifies negligence

A Chinese woman recently starved to death in an elevator after the elevator malfunctioned and workers failed to determine definitively if there anybody in the car. The woman had reportedly been in the elevator for a month at the time her body was discovered. 

According to reports, workers turned the power off the elevator and then shouted up to see if anybody was in the car. When they heard nothing in reply, they left the elevator. Nobody returned to repair it for a month. According to proper protocol, the workers should have pried open the door to check if anyone was inside. Instead they left the woman stuck between the 10th and 11th floors.

While this case happened in China, the building's maintenance arrangement mirrors that of many in the United States, where a building owner may enter into a contract with a maintenance company that does the repairs and other service work. In the event that negligence leads to injury or a tragic and unavoidable death occurs like the one that occurred in China, the building owner and the management company could both face liability.
