Families of Sandy Hook victims fight gun manufacturer in court

Families of some children and adults killed in the 2012 Sandy Hook massacre are fighting in court for the right to pursue a wrongful death lawsuit against Freedom Group, the parent company of Bushmaster Firearms. The gun manufacturer is the one that manufactured the AR-15 rifle used in the elementary school attack that killed 20 children and six adults.

Freedom Group is pushing back, citing the 2005 Protection of Lawful Commerce in Arms Act, which protects gun manufacturers from lawsuits when their guns are used for criminal activity. There is, however, a loophole in the law, which would allow lawsuits to proceed in cases where manufacturers know, or should know, that their products are likely to be used to harm others. The prosecution is seeking to use this exception to the law to argue that the wrongful death lawsuitshould be allowed to proceed.

The lawyer for the victims' families notes that the gun used in the attack is a military rifle that is sold to the public. In the case of the Sandy Hook killings, the shooter's mother had purchased the gun legally. In addition to financial compensation, the victims' families are hoping the lawsuit will mean that AR-15 rifles will no longer be able to be marketed or sold to the general public. The judge did not immediately rule on the case.
