Pennsylvania woman killed by tire on highway: Wrongful death?

Driving on Pennsylvania highways can be challenging under the best of circumstances. With changeable weather and crowded roadways, even the most careful of drivers may have difficulty avoiding a collision at times. Recently, a local woman may have suffered a tragic wrongful death in a truck accident as she traveled on Interstate 376 near Pittsburgh.

The woman was in her car with a passenger when a tire flew off of an SUV traveling in the opposite direction on the parkway. The tire bounced over the highway, striking the roof of the victim's car, The impact left her unable to drive, and her passenger was forced to steer the vehicle to the side of the road. The severely injured driver was taken to a local medical facility where she died the following day as a result of her injuries. She was only 19 years old.

The SUV driver was uninjured in the accident. Additionally, the passenger in the car that was hit by the tire suffered minor injuries and was released from a local hospital after medical treatment.

It is clear that the woman killed in this accident was the victim of an unlikely occurrence. However, it is unclear why the tire flew off of the SUV in the first place. If the accident is found to have been caused the by negligence of another party, a wrongful death action may be appropriate under Pennsylvania law. Answers to important questions will likely come as the investigations continue. The surviving family retains the right to pursue justice through our state court system if the evidence documents that negligence was the root cause of the fatal accident.
