Pennsylvania fatal crashes can lead to a wrongful death claim

A Pennsylvania man has been charged with crimes related to a fatal traffic accident that happened recently in our state. In addition, the man may find that he is liable to the survivors of the victims of the crash that he appears to have caused. In such situations, the surviving relatives of a victim may be able to file a wrongful death claim made under local personal injury laws.

The car accident that ended the lives of the two victims of the crash happened on a Pennsylvania roadway last fall. According to a report, the car driven by the now-charged man smashed head-on into the victims' vehicle. The impact caused one of the cars to roll over, and several victims to be trapped.

The car accident killed an elderly mother and her son. As a result of the crash, the driver who was responsible was charged with crimes such as careless driving. In addition to the criminal charges, the man may be liable under personal injury laws. This liability could come if the survivors of the deceased victims decide to make a claim for wrongful death against him, although there is not yet any word on whether this will occur in the immediate case.

A claim for wrongful death against a driver can be made by survivors in some situations such as this one. Under such an assertion, survivors may be able to receive an award for damages such as pain and suffering or lost wages. Though not available after every fatal accident, in many cases similar to this accident many victims or surviving relatives are able to recover some of their financial losses due to a crash, even if the emotional losses last much longer.
