Pennsylvania parents learn of defective product

A Pennsylvania case may be of interest to our readers. In it, the grieving parents of a deceased baby filed a lawsuit against the people they believe contributed to the death of their son. The fatality came after the child was held in an infant carried called the Sling Rider that may have been a defective product.

The Sling Rider was sold in Pennsylvania and across the nation through retailers such as Kmart and Wal-Mart. The defective product was manufactured by Infantino. Both the retailers and the manufacturer were named in a lawsuit filed by the parents who lost their child after using this potentially dangerous defective product.

The lawsuit asserts that the retailers and manufacture should have known that the carrier was a dangerous product when they sold it to unsuspecting parents. In addition, it says that parents should have been warned prior to purchasing the item that it could result in death or injury to a baby. However, the named defendants have asserted arguments surrounding the clams and other legal matters relating to the case.

A U.S. District Court judge recently decided that the case should be heard in Pennsylvania state courts rather than in a federal court. This decision will allow the defective product case to move forward in the coming weeks and months. As it goes through the legal process, the grieving parents, like others who have similarly suffered, will find if they can use our state' s personal injury laws to bring an action against those who made and sold the defective goods.
