Pennsylvania fitness club faulty equipment causes personal injury

Fitness enthusiasts may be interested to learn of a personal injury incident involving faulty exercise equipment at a Pennsylvania fitness club. Many people may expect to experience some soreness the next day or two after going to work out, but not ongoing pain and personal injury from the equipment malfunctioning. That is what apparently happened to a man when he went to work out at a well-known fitness club.

The injured man asserts that the fitness machine he was working out on at the time failed and he was hit on the head by some part of the machine. He complains that his head was cut and there was other pain and bruising on several parts of his body. He also suffered a concussion and symptoms of post-concussion.

As well as the immediate trauma to his body, he says the incident has caused him to suffer in several ways physically and mentally. He claims it has hampered his day to day life and usual activities. His finances have been affected, as he has had numerous hospital and doctor expenditures as a result of this accident.

Under Pennsylvania law, he can only ask for compensation up to $50,000 for the personal injury claim during arbitration. He or the fitness club from which he is seeking damages may ask for an arbitration appeal and send the case to trial, where there is no limit to what the award amount could be. The attorney for the fitness club has asked that the case be moved from the state court to the federal court.
