Best Buy at center of negligence claim by Pennsylvania couple

A Pennsylvania couple is suing Best Buy for negligence. Legal representatives for Best Buy are asking to have the civil case moved from state court to federal court, as they cite diversity of citizenship as well as the compensation amount exceeding the state limit of $50,000. The compensation amount for the negligence suit, although initially asked to be $50,000, will most likely surpass $75,000.

The couple claims that a flatbed cart had been left in one of the aisles of merchandise. The husband did not see the cart while shopping and fell over it. The aisle was used extensively by customers and the couple feels the cart should not have been left where it was.

Because of the fall, the man has suffered several injuries. He claims the injuries are keeping him from doing everyday activities but a report on the incident has not stated whether or not he is employable because of the injuries sustained. His wife is claiming loss of consortium from the outcome of the incident. The couple does say their medical bills are extensive.

If Best Buy is found liable for the injuries suffered by this man, it will be responsible for payment of the amount the court decides. It is possible the court will decide the negligence on the part of Best Buy was damaging enough that the compensation amount awarded could be more than what was requested. Any Pennsylvania resident who feels he or she has reason to file a negligence claim likely needs to research the particular state laws, as each state differs on legal code.
