Wrongful death suit filed by Pennsylvania man

A Pennsylvania man is filing a wrongful death suit against the person accused of killing the man's 10-month-old daughter and 61-year-old mother. Other named defendants in the wrongful death suit include the companies that own the apartment complex where the family lived at the time of the incident. The compensation amount the plaintiff is requesting is in excess of $50,000.

According to a report, the man accused of the murders unlawfully entered the apartment of the plaintiff with plans of kidnapping the child and seeking ransom for her return. When the grandmother tried to prevent the kidnapping, the intruder allegedly stabbed and killed her. The lawsuit claims the man then suffocated the baby in his attempts to bind her mouth to keep her silent when taking her from the apartment. The report states the purported reason for the kidnapping was to get $50,000 for paying off debt -- allegedly due to gambling.

The suit is also aimed at the complex owners for the lack of security in allowing this type of crime to occur. The plaintiff stated that, had proper security measures been enforced, these deaths would not have happened. Counts of negligence were included in the suit. The damages requested were to reimburse the plaintiff for interment and other expenses.

Wrongful death can be claimed when someone dies because of legal irresponsibility of another person or persons. There are some organizations or people who may be protected from this type of suit. In this situation, that was not the case. As each state has its own laws concerning these types of lawsuits, residents may wish to do some research pertaining to the specific laws of Pennsylvania.
