Product liability damages sought by Pennsylvania Vietnam veteran

Product liability cases stem from injuries caused when a product malfunctions. A Vietnam veteran, who is a resident of Pennsylvania, has included the U.S. Government in a lawsuit over product liability that he is filing after a fall from a wheelchair lift. He and his wife previously filed a suit against two companies over the wheelchair lift that had been installed on the outside of his home. He is seeking compensation of over $300,000 from the government and the two companies.

The plaintiff says he was in need of the wheelchair lift, as he is bound to a wheelchair for life after losing a leg in the Vietnam War. He had maneuvered his wheelchair onto the lift when the device that locked the lift in place failed to work properly. This mechanical failure caused him and his wheelchair to fall several feet to the ground. His neck was injured as a result of the fall.

His original suit was against the company that manufactured the lift and the company that installed the lift. He has added the U.S. Government to his complaint, as the Department of Veterans Affairs was the entity that acquired the lift for the plaintiff. He feels that the Department did not thoroughly research the two companies before employing them for their services.

Many Pennsylvania residents may feel they have a product liability complaint.
