Defective product lawsuit filed by injured Pennsylvania man

A Pennsylvania man has filed a suit against a truck company and two other companies from injuries he received from a defective product while on his job as a truck driver. His injuries were severe enough that he had to have a finger amputated. The man says he would not have sustained the injuries had it not been for the defective product.

The truck driver was making a delivery in another state when he realized his liftgate -- a mechanical device on the back of some delivery trucks that allows the driver to raise and lower heavy cargo into and out of the bed of the truck -- was not working properly. He called a tow truck service for assistance in repairing the device. While the two men were working on the liftgate, it collapsed and nearly crushed the tow truck mechanic. The plaintiff tried to stop the device from falling on the mechanic and, in the process, sustained severe injury to his hand and shoulder.

Along with the amputation of his finger, he has endured a great deal of physical and emotional distress. He has been admitted to the hospital numerous times for surgery and other treatments. He will continue physical therapy for an undetermined length of time, and he has lost income from not being able to work since the incident and from mounting medical bills he cannot pay. A report did not state the amount of financial compensation the man is seeking, but it does include a loss of consortium claim by his wife.

Reparation can be sought for any serious injury resulting from a defective product. Pennsylvania residents who have been hurt at the fault of another have the right to seek financial recompense from the other party. Each state differs in the handling of a product liability case, so research into the particular state laws should be carried out.
