Defective product results in baby for Pennsylvania woman

A Pennsylvania woman is filing suit against a major pharmaceutical company, claiming it is manufacturing and selling a defective product. Bayer is the company that produces Mirena, a birth control IUD. The woman filed the defective product suit when she became pregnant after having the device inserted by her doctor.

A few months after the woman had the doctor insert the device, she went to follow up on the previous visit and the IUD was in its proper place. A month later, however, she was found to be pregnant. When an ultrasound was performed, the device could not be seen. Another ultrasound weeks later showed the device had shifted and she was told it would have to be surgically removed upon giving birth. The device was removed when her doctor performed a cesarean section to deliver her baby.

The suit alleges that Bayer knew the dangers of the product but did not let the medical community nor the public know of the risks. The woman feels there was complete misrepresentation on the part of Bayer when it came to this product. A report did not state the compensation amount she is seeking but it will cover legal fees and punitive damages.

When a company chooses to sell a defective product, it should be held accountable for any damages. Whether physical, emotional or financial devastation occurred, Pennsylvania residents who have been victims of substandard manufacturing have rights to seek compensation for any harm that product may have caused.
