Pennsylvania man drowns after taking walk on beach

The summer months are prime time for vacationing at the beach. However, one Pennsylvania family's walk on the beach turned tragic, and a lawsuit claims it was due to negligence by the city, county and state.

According to reports, the family had been vacationing at a beach in another state in July 2012. The father and his 7-year-old daughter decided to take a walk on the beach, but according to the suit, the beach gave out underneath them and swept them out into the ocean. They had reportedly been in water that was only ankle deep. The 7-year-old girl was rescued by someone passing by on a watercraft, but the father drowned. He had apparently been holding his daughter up above the water.

According to the mayor of the city where the incident took place, there were signs warning people that swimming was not allowed. However, the man's wife claims there was nothing posted that warned that even walking on the beach could be dangerous. She says that police came to the vacation house for the next four days and repeatedly told her how dangerous the beach was but that people are still walking on the beach, which continues to have no warning signs.

The suit was filed against the state of New Jersey, Cape May County and the city of North Wildwood and claims that the three entities were negligent. The suit also claims that beach replenishment done at the site may have contributed to the instability of the sand.

Even unguarded beaches must have the proper signs posted warning people of any dangerous conditions present. If a city or other entity is deemed negligent by the courts, the victims may be able to be awarded compensation through a personal injury suit to help pay for any expenses incurred and help the victims or surviving family members find closure.
