Unregulated obstacle races can breed injury

Tough Mudder, Warrior Dash, Spartan Race -- these are popular obstacle-course events that lure participants with the exhilarating promise of mud pits, fire hurdles, long-distance runs, potential electrical shocks and other obstacles that test physical stamina, not to mention provide lively opportunity for camaraderie and Instagram fodder. 

But these events have also led to many accidents and injuries, and even death. Participants have suffered heat-related illness, electrical shocks, drownings, fractures and paralysis, and the lawsuits have followed.

Part of the lure of these events, to be sure, is the danger factor. Young people who may want to prove themselves, or experience the exhilaration of surviving a dangerous course, may feel invincible or take risks that might, in normal circumstances, seem unreasonable. That these obstacles courses are organized sporting events can give participants a sense of safety that may not always be warranted; particularly given the fact that there are not officially sanctioned safety standards in place.

If you or a loved one is injured at one of these events, you may fear that the liability waiver you signed may mean you won't be allowed to sue to recover compensation for your losses and expenses. This isn't always true. Where race organizers failed to provide adequate warning or safety measures, including trained medical personnel, you may have grounds for a successful lawsuit.
