Who Can You Sue For Distracted Driving?

If you've been injured in distracted driving accident, there could be a cascade of parties bearing partial responsible for the crash, depending on the circumstances. Distracted drivers. Drivers themselves make the decision to text while driving, or engage in other activities (eating, taking photos, reading texts) that take their attention away from the road. Drivers would be the most obvious negligent parties in a distracted driving accident. 

Employer of the driver. If the driver is an employee of a commercial enterprise and the crash happened during the course of business, the employer could be named in a lawsuit. This is particularly true if the driver was engaged in texting or another distracting activity that was required by the employer. Of particular concern is whether the employer had a cell phone policy in place at the time of the accident, and if the policy had been enforced. 

Someone on the other end of the phone. If the person texting or talking to the person who caused the accident knew that the driver was driving, but continued to text or talk to that person, he or she could be held partially liable for the crash. 

App designers. In some cases, designers of apps that were in use at the time of the crash can be held partially responsible for accidents. This is particularly true if the app itself encouraged unsafe behavior of some sort.
