Peril In A Parking Structure

Roads aren't the only place where car accidents can occur. Drivers, passengers, pedestrians and bikers can be injured from accidents that take place in parking structures as well. While vehicles in parking structures generally are not moving at high speeds the way they do on highways, the impact of parking lot collisions can still be substantial, and cars and people alike can sustain damage, too. People have even had freak accidents resulting in severe injuries in parking structures when their cars plunged off of an upper level, crashing to the ground below.

Most parking structure accidents are not this severe, however, and involve collisions between cars vying for space in close quarters. Determining fault in such accidents depends on two factors:

  • Which car had the right of way
  • Were both cars moving, or was just one moving?

Who is at fault?

If one car is moving and one is stationary (parked), the car that is moving is typically the car at fault. This applies in situations where one moving car strikes a parked car, or where one car suddenly stops and the car in back rear-ends the front car.

When both cars are moving, you have to look to who had the right of way to determine which driver was at fault. In accidents involving one car pulling out of a space and another car traveling through the lot, the car pulling out of the space is usually at fault, as the car moving through the lane has the right of way. In situations where both cars are moving, the driver crossing the lane of traffic is usually the one at fault.
