What to Do – and Not Do – After a Car Accident

A car accident can leave you shaken, injured, and unsure of what to do next. Understanding the right steps to take following an accident can greatly influence your health and affect your chances of securing compensation in the future. With that in mind, here are three pointers for what to do and what to avoid to help protect your rights after an accident.

First and foremost, prioritize safety. If you’re able, move to a safe location and call 911. Even if injuries seem minor, a police report gives you a written record of the accident, which is critical to a future claim. Seek medical attention as soon as possible. Some injuries, like whiplash or internal trauma, may not immediately show symptoms but can worsen over time. It’s very important to NEVER make assumptions about your well-being.

Second, document the scene and report the accident. Take cellphone photos of your vehicle’s damage, make note of the road conditions, traffic signals, and signs, and take photos of any visible injuries. Make sure to ascertain the other driver’s identity and automobile insurance. If there are witnesses nearby, be sure to ask for their contact information. It’s imperative to never discuss fault at the scene or with the other driver’s insurance company, because statements made too early can be misunderstood or used against you.

Third, notify your insurance provider as soon as possible, but avoid giving any recorded statements. Insurance companies generally try to minimize payouts, even when you’re not at fault. And that is where experienced legal guidance is most important.

Finally, do not leave the scene of the accident without exchanging the necessary information or calling and waiting for the police. This could not only cause issues in a personal injury case but also expose you to criminal charges.
