Common Issues When Filing Workers Compensation Claim
We know how to anticipate challenges and issues in your workers’ compensation case, but there are some common issues in work injury claims that you should know about. These include:
- When you are injured, you must notify your employer immediately. The WC ACT requires you to provide notice to the Employer of a Work Injury within 120 days from the work incident. However, each respective Employer may have their own notice requirement within a bargaining agreement and/or employment contract.
- Initial claim denied? Do not get frustrated, contact us. Many claims are denied, especially if you do not have representation. We can help you file your claim and represent you from start to finish and everything in-between.
- Medical treatment: You are entitled to medical treatment related to your work injuries. It is important that you seek treatment, keep records of all of your doctor’s appointments, and keep notes on your treatment plans.
- Was your pre-existing condition aggravated by a work accident? Conditions and Injuries that have been aggravated by your work incident are covered under Pennsylvania Workers’ Compensation Law.
- The insurance company can conduct surveillance: Insurance companies often survey claimants in an attempt to find evidence to deny or underpay a claim. Do not panic but be mindful of their presence.
- Safely returning to work: You have the right to return to work based on your medical needs, not your employer’s needs.
